1. Acceptance of Terms
By accessing or using FitmentHub ("the Platform"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Platform. These terms apply to all visitors, users, buyers, and sellers.
2. About FitmentHub
FitmentHub is an Australian online marketplace connecting buyers and sellers of automotive wheels, tyres, and related parts. We facilitate listings and communications but are not a party to transactions between users.
3. Eligibility
- You must be at least 18 years of age to use the Platform.
- By registering, you confirm that the information you provide is accurate and complete.
- You are responsible for maintaining the security of your account credentials.
4. User Accounts
You are responsible for all activity that occurs under your account. You must not share your login credentials or allow others to access your account. FitmentHub reserves the right to suspend or terminate accounts that violate these terms.
5. Listings and Transactions
- Sellers are solely responsible for the accuracy, legality, and quality of their listings.
- Buyers are encouraged to verify fitment, condition, and compatibility before purchasing.
- FitmentHub does not guarantee the accuracy of any listing information.
- Transactions are between the buyer and seller. FitmentHub is not liable for disputes, defective goods, or non-delivery.
- Payments processed through the Platform are subject to our payment provider's (Stripe) terms.
6. Prohibited Conduct
You must not:
- Post fraudulent, misleading, or illegal listings
- Harass, threaten, or abuse other users
- Use the Platform to spam or send unsolicited messages
- Attempt to circumvent our payment system or fees
- Scrape, copy, or redistribute Platform content without permission
- Use automated tools or bots to access the Platform
7. Fees and Payments
Certain features on FitmentHub require payment, including membership plans, listing boosts, and featured placements. All fees are in Australian Dollars (AUD) and are non-refundable unless otherwise stated. FitmentHub charges a platform fee on applicable transactions.
8. Intellectual Property
All content on the Platform including logos, design, and software is the property of FitmentHub. You retain ownership of content you submit, but grant FitmentHub a non-exclusive licence to display it on the Platform.
9. Limitation of Liability
To the maximum extent permitted by Australian law, FitmentHub is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform or any transaction conducted through it.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of NSW.
11. Changes to Terms
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new terms. We will notify users of significant changes.
